Limitation of Liability |
IEMS shall not be liable for any injury, loss, claim, or damage, nor any indirect, special, incidental or consequential damages of any kind, whether based in contract, tort, strict liability or otherwise, which arises out of (a) the use of, or inability to use, this site or content found in this site, or (b) unless resulting from the gross negligence or intentional actions of IEMS, the unauthorized access to or alteration of your transmissions or data, even if IEMS has been advised of the possibility of such damages. Fees and Charges There is no charge for use of these services. If any bill payment or related charges results in non-sufficient funds, you may be charged a $20 fee. Payment Authorization and Payment Remittance When the service receives a payment instruction you authorize us to debit your payment account and remit funds to IEMS. By using this service you authorize the service to follow the payment instructions that it receives from you or any authorized parties. IEMS will use its best efforts to make all your payments properly. However, we shall incur no liability if we are unable to complete any payments initiated by you because of the existence of any one or more of the following circumstances: · If, through no fault of ours, you do not have enough money in your account to make the transfer. · If the transfer would go over the maximum amount of any related line of credit or overdraft protection limit. · If the terminal or system was not working properly and you knew about the breakdown when you started the transfer. · If the funds in your account are subject to legal restrictions, such as garnishment or attachment, or if the account is subject to a pledge or security agreement. · If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken. |
